Overview

Welcome to Pixel Parables, which is provided by RETVRN, LLC, or one of its affiliated companies (“Company,” “we,” “us,” or “our”). Pixel Parables is an online subscription service where we provide our subscribers with access to Christian-themed interactive books, images, audio, video, and tools for generating customized content ("Custom Content") via the Internet. Our platform utilizes third-party services for essential functions, including data hosting and the operation of Artificial Intelligence (AI) models. These AI models are employed both by us to create a significant portion of our base content and by you, the Account Owner, to generate Custom Content using our provided tools. It is crucial to understand that our platform and data, including data processed during Custom Content generation, reside on and are processed by these third-party systems. Pixel Parables, including without limitation all features and functionalities, our website, user interfaces, content customization tools, and all content and software associated therewith (whether hosted by us or third parties), is referred to herein as the “Pixel Parables service” or “service.”

The following outlines our detailed terms and conditions. You should read and understand them as they govern your use of our service. These Terms of Use provide that BINDING ARBITRATION will resolve all disputes between you and Pixel Parables. YOU AGREE TO GIVE UP YOUR RIGHT TO GO TO COURT to assert or defend your rights under this Agreement (except for matters that may be taken to small claims court). Your rights will be determined by a NEUTRAL ARBITRATOR and NOT a judge or jury, and your claims cannot be brought as a class action. Please review the Arbitration Agreement section below for your Agreement’s details to arbitrate any disputes with Pixel Parables.

These Terms of Use further provide for AUTOMATICALLY RENEWING SUBSCRIPTIONS. Unless you subscribe to a free or limited-access tier, we will bill you via our payment processor (Stripe) for an automatically renewing monthly subscription term for your use and access to the premium features of the service. Please review the following sections below for further details: Subscriptions, Billing, Ongoing Membership, and Cancellation.

These Terms of Use are also a resource for you to get a deeper understanding of how our service works, including the way we bill, how we interact with you, and other details about our service. We encourage you to revisit these Terms of Use when you have a question about the service or want to know how something works.

Acceptance of Terms of Use

These Terms of Use govern your use and access to the Pixel Parables service. By using, visiting, or browsing the Pixel Parables service (including accessing free content or registering an account, whether via direct registration or third-party social media logins like Google or Facebook), you accept and agree to be bound by these Terms of Use. If you do not agree to these Terms of Use, you should not use the Pixel Parables service, including our website and user interfaces. We may immediately terminate this Agreement with you and your access to the services if we determine, in our sole discretion, that you have failed to comply with any provision of these Terms of Use.

Changes to Terms of Use

Pixel Parables reserves the right, from time to time, with or without notice to you, to change these Terms of Use at our sole and absolute discretion. The most current version of these Terms of Use can be reviewed by visiting our website and clicking on “Terms of Use” located at the bottom of the pages of the Pixel Parables website. The most current version of the Terms of Use will supersede all previous versions. If these Terms of Use have been updated since you last accessed or used the service, you acknowledge and agree that your continued access or use of the service constitutes your acceptance of the changed Terms of Use.

Privacy and Electronic Communications

Any personally identifying information submitted by you, the Account Holder, through the Pixel Parables service is subject to our Privacy Policy, the terms of which are incorporated herein by reference. Please review our Privacy Policy to understand our practices. Our Privacy Policy provides crucial details regarding how we handle data, including our use of third-party social media logins (which are strictly for Account Holder authentication and do not involve collecting or sharing child PI with social platforms) and our engagement with third-party services for data hosting and AI-driven content generation. The Privacy Policy further elaborates on the specific nature of data processed by such third-party AI services for content generation (including data related to your generation of Custom Content and its association with your account for access and usage monitoring purposes) and any contractual limitations imposed on their use of such data. You acknowledge that understanding these details in the Privacy Policy is essential. The date of any changes to our Privacy Policy will be noted within the policy. By using our service, you, as the Account Holder, consent to the collection and use of your data as outlined in our Privacy Policy.

You further agree to receive certain electronic communications from us. For example, Pixel Parables may send you newsletters about new Pixel Parables features, special offers, promotional announcements, and customer surveys via e-mail or other methods. By using the Pixel Parables service, you consent to receiving these electronic communications from Pixel Parables. These communications will include notices about your account (e.g., change in password or Payment Method, confirmation e-mails, and other transactional information) and information concerning or related to our service. These communications are part of your relationship with Pixel Parables, and you receive them as part of the Pixel Parables membership. You agree that any notice, agreements, disclosure or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing. You may opt-out of non-transactional electronic communications as described in our Privacy Policy or through the unsubscribe mechanism provided in such communications.

Subscriptions

You can find the specific details regarding your membership with Pixel Parables, including your current subscription plan and billing information, at any time by visiting our website and clicking on the “My Account” link, which may redirect to our payment processor, Stripe, for certain account management functions.

We offer a monthly subscription service that provides access to our full range of interactive books, images, videos, audio, and Custom Content generation tools. The volume of Custom Content an Account Owner may generate may be subject to limitations as described within the service or in your subscription plan details. A limited selection of content may be available without a paid subscription. We may also offer special promotional plans or memberships with different limitations. Some of these promotional memberships may be offered by third parties in conjunction with the provision of their own products and services; we are not responsible for the products and services provided by such third parties. We reserve the right to modify, terminate, or otherwise amend our offered membership plans, including any membership fees and other associated fees, with prior notice to you as required by applicable law. Unless otherwise stated differently, "month" or "monthly" refers to your recurring billing cycle (See “Billing” below). You acknowledge and agree that your current paid membership plan will automatically renew each month until you cancel it or it is terminated by us in accordance with these Terms.

Billing

By starting your Pixel Parables paid membership, you expressly agree that we, through our third-party payment processor (Stripe), are authorized to charge you a periodic (monthly) membership fee at the then-current rate, and any other charges you may incur in connection with your use of the Pixel Parables service, to the Payment Method you provided during registration or as subsequently updated in your “My Account” settings or directly with Stripe. Please note that prices and charges are subject to change with prior notice to you. As used in these Terms of Use, “billing” shall indicate either a charge or debit, as applicable, against your Payment Method.

The membership fee will be billed at the beginning of the paying portion of your membership and each month thereafter unless and until you cancel your membership. We automatically bill your Payment Method each month on the calendar day corresponding to the commencement of your paying membership, or as otherwise set by Stripe. Membership charges are fully earned upon payment. In the event your paying membership began on a day not contained in a given month, your Payment Method may be billed on or around the last day of such month, or as otherwise determined by Stripe. You acknowledge that the amount billed each period may vary for reasons that may include differing amounts due to promotional offers, changes in your plan, or changes in applicable taxes, and you authorize us (through Stripe) to charge your Payment Method for such varying amounts.

For certain Payment Methods, the issuer of your Payment Method may charge you a foreign transaction fee or other related charges. Check with your bank and credit card issuers for details.

If you are eligible for and have signed up for a free trial period, your Payment Method may be authorized at the beginning of the free trial; however, no charges will be made against the Payment Method for the subscription fee unless you do not cancel prior to the end of your free trial period. We may also periodically authorize your card in anticipation of membership or related charges.

Membership fees are fully earned upon payment. WE DO NOT PROVIDE REFUNDS OR CREDITS FOR ANY PARTIAL-MONTH MEMBERSHIP PERIODS OR UNUSED CONTENT. At any time, and for any reason, we MAY provide a refund, discount, or other consideration to some or all of our members (“credits”). The amount and form of such credits, and the decision to provide them, are at our sole and absolute discretion. The provision of credits in one instance does not entitle you to credits in the future for similar instances, nor does it obligate us to provide credits in the future, under any circumstance.

We may change the fees and charges in effect, or add new fees and charges from time to time, but we will give you advance notice of these changes by e-mail or other electronic means. If you wish to use a different Payment Method or if there is a change in your Payment Method details, such as your credit card validity or expiration date, you must update your information through the “My Account” link on our website or directly with Stripe, as applicable. If your Payment Method reaches its expiration date and you do not update your Payment Method information and payment is declined, your subscription may be terminated or suspended. You remain responsible for any uncollected amounts.

Ongoing Membership

A Pixel Parables paid membership will automatically renew on a monthly basis unless you cancel your membership or we terminate it in accordance with these Terms. You must cancel your membership through your "My Account" page, which may be managed via our third-party payment processor (Stripe), before it renews each month to avoid billing of the next month’s membership fees to your Payment Method. We will bill the membership fee to the Payment Method you provided during registration or as subsequently updated. Membership fees are fully earned upon payment.

Cancellation

You may cancel your Pixel Parables paid membership at any time. To cancel, visit our website and navigate to the “My Account” page, and follow the instructions for cancellation, which may be processed through our third-party payment processor, Stripe. Upon cancellation, your access to the paid features of the service will continue until the end of your current monthly billing period. WE DO NOT PROVIDE REFUNDS OR CREDITS FOR ANY PARTIAL-MONTH MEMBERSHIP PERIODS OR UNUSED CONTENT. Access to any features or content that were exclusive to your paid subscription will terminate at the end of your final billing period.

Availability of Content and Service

The availability of specific interactive books, images, audio, video, and Custom Content generation tools ("Content") on the Pixel Parables service may change from time to time and may vary by geographic location or other factors. The quality of the display and performance of the Content may vary from computer to computer, and device to device, and may be affected by various factors, such as your location, the bandwidth available through and/or speed of your Internet connection, and the capabilities of your device. Pixel Parables relies on third-party hosting providers for the delivery of its service and Content.

You are responsible for all Internet access charges. Please check with your Internet service provider for information on possible Internet data usage charges. Pixel Parables makes no representations or warranties about the quality of your experience accessing or interacting with the Content.

Content Load Time and Access

The time it takes to begin accessing or interacting with Content may vary based on a number of factors, including your location, available bandwidth at the time, the specific Content you have selected, the configuration of your device, and the performance of third-party hosting and content delivery networks. You must be connected to the Internet to access and use the Pixel Parables service.

Offline Content

Pixel Parables does not currently offer features for temporary download and offline viewing of Content. Access to all Content requires an active Internet connection.

Device Requirements and Limitations

To access the Pixel Parables service, your computer or other internet-enabled device must satisfy certain system requirements, which may change from time to time. These typically include a modern web browser and a stable internet connection. The number of devices through which you may concurrently access your account may be subject to limitations, which we reserve the right to change without notice.

Geographic Limitation

You may access the Pixel Parables service and its Content only in geographic locations where we offer our service and have the rights to provide such Content. The Content available may vary by geographic location. Pixel Parables may use technologies to verify your geographic location.

Pixel Parables Service Software and Platform

The Pixel Parables service is provided through software and platform infrastructure hosted by third-party service providers. We do not warrant that any of the software or technology used in connection with our service will be compatible with other third-party software or hardware not explicitly supported by us. You may not copy, reproduce, decompile, reverse engineer, disassemble, modify, or create derivative works of any of the software, technology, or Content associated with the Pixel Parables service or any portion thereof, except as expressly permitted for the generation of Custom Content through the provided tools and within the intended functionality of the service. Any unauthorized use of the service, its software, or Content is strictly prohibited.

Pixel Parables reserves the right to modify or discontinue any aspect of the service, including software applications or features, at any time, with or without notice. We are not responsible for the performance or continued compatibility of your specific devices with our service, beyond general compatibility with standard web browsers and internet access. Any issues related to your device should be directed to the device manufacturer or seller.

In response to requests from our own content creators, licensors, or due to technical limitations, changes in third-party service provider offerings, or any reason in our sole and absolute discretion, and without prior notice to you (unless otherwise required by law), some or all Content or features may cease to be available or may be modified.

Passwords and Account Access

The adult member (18 years of age or older) who created the Pixel Parables account and whose Payment Method is charged is referred to herein as the “Account Owner.” The Account Owner has access and control over the Pixel Parables account. This control is exercised through the use of the Account Owner’s password and, if applicable, the credentials for any third-party social media account (e.g., Google, Facebook) used to sign in. To maintain exclusive control, the Account Owner must not reveal their password or social media login credentials to anyone.

The Account Owner is responsible for all activity that occurs through their Pixel Parables account. BY CREATING AN ACCOUNT AND USING THE PIXEL PARABLES SERVICE, THE ACCOUNT OWNER AGREES TO BE RESPONSIBLE FOR ENSURING THAT ANY USE OF THE SERVICE BY MINORS (INCLUDING CHILDREN UNDER THE AGE OF 13) OCCURS ONLY WITH THE ACCOUNT OWNER'''S DIRECT INVOLVEMENT, SUPERVISION, AND APPROVAL. THE PIXEL PARABLES SERVICE IS INTENDED FOR PARENTS OR LEGAL GUARDIANS TO USE WITH THEIR CHILDREN. IT IS NOT INTENDED FOR UNSUPERVISED USE BY CHILDREN. The Account Owner explicitly acknowledges their understanding that the service content is directed towards children aged 1-4, and further agrees that they, the Account Owner, are solely responsible for determining the suitability of all content, including any AI-generated Custom Content, for their child(ren) before presenting it to them. The Account Owner is solely responsible for any access to and use of the service by household members or other individuals to whom they have provided access, and the Account Owner shall be responsible for the actions of such individuals. Any use of the service by individuals under the age of 18 must occur under the Account Owner'''s account and with the consent, involvement, supervision, and permission of the Account Owner, who must be a parent or legal guardian of the age of majority or older.

The Account Owner is and shall be solely responsible for all activities that occur under or in connection with their account. The Account Owner agrees to release the Company from, and indemnify and hold harmless the Company against, any and all liability associated with such activities. To prevent unauthorized alterations to account control, the Account Owner should not reveal specific Payment Method details (e.g., the last four digits of their credit or debit card) to others if such information could be used to impersonate them with Customer Service.

Third-Party Applications and Services

You may encounter third-party applications, websites, software, or other software utilities (“Applications”) that interact with or are linked from the Pixel Parables service. These Applications are not owned, operated, or endorsed by Pixel Parables unless explicitly stated. Such Applications may import data related to your Pixel Parables account and activity or otherwise gather data from you if you choose to use them.

These Applications are provided solely as a convenience to you. Pixel Parables is not responsible for the content, privacy practices, or terms of use of such Applications. SUCH APPLICATIONS ARE OWNED OR OPERATED BY THIRD PARTIES THAT ARE NOT RELATED TO, ASSOCIATED WITH, OR SPONSORED BY PIXEL PARABLES AND MAY NOT BE AUTHORIZED FOR USE WITH OUR SERVICE IN ALL COUNTRIES.

Your use of any third-party Application is at your sole and absolute discretion and risk. If you choose to use an Application, it may interact with, connect to, or gather information from and to your Pixel Parables account. By using such Applications, you acknowledge and agree that: (i) if you use an Application to share information relating to your Pixel Parables account, you are consenting to the information about your account being shared; (ii) your use of an Application may cause personally identifying information to be publicly disclosed and/or associated with you, even if Pixel Parables has not provided such information; and (iii) YOUR USE OF AN APPLICATION IS AT YOUR OWN OPTION AND RISK, and you will hold Pixel Parables harmless for the sharing of information relating to your Pixel Parables account that results from your use of an Application. The Application’s end-user license agreement, terms of use, and privacy policy will govern your use of that Application.

If you have any questions, concerns, complaints, or claims about third-party Applications, you should contact the support or contact personnel of the Application and not Pixel Parables, unless otherwise indicated by Pixel Parables. PIXEL PARABLES DISCLAIMS ALL LIABILITY ARISING FROM YOUR USE OF THIRD-PARTY APPLICATIONS.

Note that the Pixel Parables service itself utilizes third-party service providers for essential functions such as data hosting, payment processing (Stripe), and aspects of content generation via AI tools. Our use of these essential third-party services is governed by our Privacy Policy. Our Privacy Policy details that these third parties are contractually and/or by our directive prohibited from using data processed on our behalf for their own independent purposes, including but not limited to training their general AI models, unless such use is explicitly disclosed in our Privacy Policy and, for any Personal Information collected from a child, is subject to separate, explicit Verifiable Parental Consent (VPC). We do not currently permit the use of any Personal Information collected from a child for the purpose of training third-party AI models.

Account Access; Identity Protection

To provide you with ease of access to your account and to help administer the Pixel Parables service, Pixel Parables may implement technology that enables us to recognize you as the Account Owner and provide you with direct access to your account without requiring you to retype your password or other user identification when you revisit the Pixel Parables service. This may include recognizing your device or using information from your third-party social media login.

You are responsible for updating and maintaining the truth and accuracy of the information you provide to us relating to your account. You are also responsible for maintaining the confidentiality of your account password (and the credentials for any linked third-party social media account) and for restricting access to your device(s) used to access Pixel Parables. If you disclose your password or share your account and/or devices with other people, you take full responsibility for their actions, including any use by minors not under your direct supervision as required by these Terms.

Users of public or shared devices should log out at the completion of each visit. If you sell or return a device used to access Pixel Parables, you should log out and/or deactivate the device from your account settings if possible before doing so. Similarly, if your device is lost or stolen, please take steps to secure your account, such as changing your password and deactivating the device if possible. If you fail to log out or deactivate your device, subsequent users may access the Pixel Parables service through your account and may be able to access certain of your account information.

If you find that you are a victim of identity theft and it involves a Pixel Parables account, you should notify our Customer Service immediately. You should also report this instance to your card issuers, relevant social media platforms if their logins were compromised, and your local law enforcement agency. Be mindful of any communication requesting that you submit credit card or other account information. Providing your information in response to these types of communications can result in identity theft. Always access your sensitive account information by going directly to the Pixel Parables website (or our payment processor, Stripe, for payment information) and not through a hyperlink in an e-mail or any other electronic communication, even if it looks official.

Pixel Parables reserves the right to place any account on hold at any time, with or without notification to the member, in order to protect itself, its partners, and its users from what it believes to be fraudulent activity. Pixel Parables is not obligated to credit or discount a membership for holds placed on the account by either a representative of Pixel Parables or by the automated processes of Pixel Parables.

Disclaimers of Warranties and Limitations on Liability

THE PIXEL PARABLES SERVICE, INCLUDING OUR WEBSITE, USER INTERFACES, CONTENT CUSTOMIZATION TOOLS, ALL CONTENT (INCLUDING CONTENT GENERATED THROUGH THIRD-PARTY AI SERVICES AND HOSTED BY THIRD-PARTY PROVIDERS), AND SOFTWARE ASSOCIATED THEREWITH, OR ANY OTHER FEATURES OR FUNCTIONALITIES ASSOCIATED WITH THE PIXEL PARABLES SERVICE, ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. WE AND OUR LICENSORS MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND WITH RESPECT TO THE PIXEL PARABLES SERVICE, OUR WEBSITE, USER INTERFACES, AND ALL CONTENT AND SOFTWARE ASSOCIATED THEREWITH.

PIXEL PARABLES DOES NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE PIXEL PARABLES SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, ACCURATE, OR RELIABLE (ESPECIALLY CONCERNING CONTENT GENERATED VIA THIRD-PARTY AI SERVICES). YOU AGREE THAT PIXEL PARABLES MAY ELIMINATE OR OTHERWISE MODIFY ANY OR ALL ASPECTS OF THE PIXEL PARABLES SERVICE, INCLUDING FEATURES AND CONTENT AVAILABILITY, WITHOUT COMPENSATION OR NOTICE TO YOU, UNLESS OTHERWISE REQUIRED BY LAW. PIXEL PARABLES SPECIFICALLY DISCLAIMS LIABILITY FOR THE USE OF THIRD-PARTY APPLICATIONS, YOUR DEVICES USED TO ACCESS THE SERVICE, AND THE PIXEL PARABLES PLATFORM (INCLUDING THEIR CONTINUING COMPATIBILITY WITH OUR SERVICE). FURTHERMORE, YOU ACKNOWLEDGE THAT THE CUSTOM CONTENT GENERATION TOOLS UTILIZE AI AND THAT YOU, AS THE ACCOUNT OWNER, ARE SOLELY RESPONSIBLE FOR THE SELECTIONS MADE TO GENERATE CUSTOM CONTENT AND FOR REVIEWING ANY SUCH CUSTOM CONTENT FOR SUITABILITY BEFORE SHARING IT WITH YOUR CHILD(REN). PIXEL PARABLES DISCLAIMS ALL LIABILITY FOR THE SPECIFIC OUTPUTS OR SUITABILITY OF CUSTOM CONTENT GENERATED UNDER YOUR DIRECTION.

Without limiting the foregoing, we and our licensors assume no liability or responsibility for any of the following: (i) errors, inaccuracies, or omissions in the Content delivered by the Pixel Parables service, whether on the Pixel Parables website, user interfaces, or within generated Custom Content; (ii) recommendations or advice of Customer Service; (iii) any failure, interruption, or unavailability of the Pixel Parables service and/or website or user interfaces, including those due to reliance on third-party hosting and AI service providers; (iv) delivery and or display of any Content contained on the Pixel Parables website, user interfaces, or otherwise through the Pixel Parables service; and (v) any losses or damages arising from the use of the Content provided on the Pixel Parables website, user interfaces, or otherwise through the Pixel Parables service itself, including any losses or damages arising from the use of related software or any conduct by users of the Pixel Parables service, website or user interfaces.

TO THE EXTENT ALLOWABLE BY LAW, WE AND OUR LICENSORS DISCLAIM ALL REPRESENTATIONS AND WARRANTIES, INCLUDING, FOR EXAMPLE, WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. In addition, we do not represent or warrant that the information accessible via our site is accurate, complete, or current. We do not make any representations with respect to the Content available through the Pixel Parables service or the descriptions of any Content contained on our website and user interfaces. We do not represent or guarantee that your use of the Pixel Parables service will be free from interruption, loss, corruption, attack, viruses, interference, hacking, or other security intrusions, and we disclaim any liability with respect thereto. No oral or written information or advice given by us or our authorized representative shall create a warranty or otherwise constitute a representation binding upon Pixel Parables or its affiliated parties.

IN NO EVENT SHALL PIXEL PARABLES, OR ITS SUBSIDIARIES, AFFILIATES, OR ANY OF THEIR SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES, OR LICENSORS BE LIABLE (JOINTLY OR SEVERALLY) TO YOU FOR PERSONAL INJURY OR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND, OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS, BUSINESS INTERRUPTION OR ANY OTHER COMMERCIAL DAMAGES OR LOSS, WHETHER OR NOT ADVISED OF THE POSSIBILITY OF DAMAGE, AND ON ANY THEORY OF LIABILITY, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE PIXEL PARABLES SERVICE, OUR WEBSITE, USER INTERFACES, AND ALL CONTENT (INCLUDING CUSTOM CONTENT AND AI-GENERATED CONTENT) AND SOFTWARE ASSOCIATED THEREWITH, OR OTHERWISE RELATED TO THE PIXEL PARABLES SERVICE. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES FOR LOSSES ARISING FROM THE USE OR INABILITY TO USE THE PIXEL PARABLES SERVICE, INCLUDING OUR WEBSITE, USER INTERFACES, AND ALL CONTENT AND SOFTWARE ASSOCIATED THEREWITH (OTHER THAN AS MAY BE REQUIRED BY APPLICABLE LAW IN CASES INVOLVING PERSONAL INJURY) EXCEED THE AMOUNT OF ONE (1) MONTHLY MEMBERSHIP FEE ON YOUR MEMBERSHIP PLAN. THE FOREGOING LIMITATIONS WILL APPLY EVEN IF THE ABOVE STATED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

PIXEL PARABLES MAKES NO REPRESENTATIONS OR WARRANTIES CONCERNING THE DEVICES YOU USE TO ACCESS OUR SERVICE OR THE COMPATIBILITY OF SUCH DEVICES WITH OUR SERVICE. Additional disclaimers or limitations of liability may be contained in the various third-party software end user license agreements or terms of service you may have agreed to in order to access components of our service or underlying technologies.

Intellectual Property

The Pixel Parables service, including all Content included on the Pixel Parables website and user interfaces, or delivered to members as part of the service, including, but not limited to, interactive books, images, videos, audio, Custom Content generation tools, templates, pre-set elements for customization, text, graphics, logos, designs, photographs, button icons, digital downloads, data compilations, and software (collectively, the "Service Materials"), are the property of RETVRN, LLC (hereinafter "Pixel Parables"), its affiliates, or its licensors, and are protected by United States and international copyright, trade secret or other intellectual property laws and treaties.

The compilation of all Service Materials provided by Pixel Parables on our website and user interfaces or in connection with the Pixel Parables service are the exclusive property of Pixel Parables and its licensors and are protected by copyright and trade secret laws in the territories in which the Pixel Parables service operates and by international treaty provisions. Service Materials shall not be reproduced, distributed, publicly displayed, publicly performed, modified, or used to create derivative works without express written permission from Pixel Parables or its licensors, except as explicitly permitted for the creation of Custom Content by an Account Owner using the tools provided within the service for personal, non-commercial use as intended and described herein.

You agree to adhere to the restrictions set forth under “Pixel Parables Service Software and Platform” and “Limitations on Use.” You agree not to decompile, reverse engineer or disassemble any software or other products or processes accessible through the Pixel Parables service, not to insert any code or product or manipulate the Content of the Pixel Parables service in any way (outside of intended Custom Content generation), and not to use any data mining, data gathering or extraction method. Pixel Parables reserves the right to terminate your membership hereunder if Pixel Parables, in its sole and absolute discretion, believes that you are in violation of Pixel Parables software or platform restrictions, restrictions against copying or unauthorized use of Service Materials, or other unauthorized use of our proprietary content in violation of the copyrights of Pixel Parables and its licensors.

Pixel Parables does not promote, foster, or condone the unauthorized copying of its Service Materials or any other infringing activity. The use of the Pixel Parables service, including all Service Materials made available to you by us, is solely for your personal and non-commercial use as an Account Owner, primarily for engaging with your child(ren) as intended by the service. Please see the instructions at the end of these Terms of Use for notifying us of the presence of any allegedly infringing content on the Pixel Parables service.

Regarding Custom Content generated by an Account Owner using the tools provided by Pixel Parables (which are limited to selections from pre-determined dropdowns with no free-form data entry by users): while you may use such Custom Content for your personal, non-commercial purposes as facilitated by the service, Pixel Parables and/or its licensors retain all underlying intellectual property rights in the tools, templates, pre-set elements, and the AI models used for generation. Your rights to the specific compilation of Custom Content are limited to use within and as permitted by the Pixel Parables service. To facilitate your access to your Custom Content and for us to monitor service usage, including any limitations on the volume of Custom Content that may be generated by an Account Owner, we will associate your Account Owner account with the Custom Content you create. The data practices related to this association and monitoring are further detailed in our Privacy Policy. We grant you, the Account Owner, a limited, revocable, non-exclusive, non-transferable license to use the specific compilation of Custom Content you generate, solely for your personal, non-commercial purposes within the Service, for as long as your account remains active and in good standing, and for no other purpose, including but not limited to public display outside the Service or any use implying endorsement by Pixel Parables, unless separately and explicitly authorized by us in writing. Pixel Parables makes no claim to own any truly novel and original expression inherent in your specific compilation, but explicitly retains ownership of all underlying Service Materials, tools, and processes.

Trademarks

Pixel Parables™ is a trademark of RETVRN, LLC. The Pixel Parables logo and pixelparables.com (and any associated domain names) are trademarks or service marks of RETVRN, LLC. The Pixel Parables website and user interfaces, including but not limited to its graphics, logos, page headers, button icons, scripts, and service names constitute trade dress of RETVRN, LLC. The trademarks, service marks, and trade dress of Pixel Parables may not be used or reproduced without prior written approval from RETVRN, LLC and may not be used in connection with any product or service that is not affiliated with Pixel Parables, in any manner that is likely to cause confusion among customers, in any manner that dilutes the rights of Pixel Parables, or in any manner that disparages or discredits Pixel Parables. Other trademarks that appear on the Pixel Parables website and user interfaces are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Pixel Parables. Any images of persons or personalities contained on the Pixel Parables website and user interfaces are not an indication or endorsement of Pixel Parables or any particular product or our service unless otherwise indicated.

Entertainment and Service Content

We distribute interactive books, images, audio, video, and provide tools for generating Custom Content (collectively "Content"). We reserve the right to display and promote this Content or additional information through our service, including our website and user interfaces, to you in any manner we choose in our sole and absolute discretion. Any opinions, advice, statements, services, offers, or other information that constitutes part of the Content expressed or made available by third parties (such as through underlying AI models used for content generation) through the Pixel Parables service are those of the respective authors, producers, or originating services, and not necessarily of Pixel Parables or its shareholders, directors, officers, or employees or licensors. Under no circumstances shall Pixel Parables, or its shareholders, directors, officers, or employees or licensors be held liable for any loss or damage caused by your reliance on information obtained through the Pixel Parables service. It is your responsibility as the Account Owner to evaluate the information, opinion, advice, or other Content available through the Pixel Parables service, and to determine its suitability for use with your child(ren).

Use of Information Submitted

Pixel Parables is free to use any comments, information, ideas, concepts, reviews, or techniques or any other material contained in any communication you, as the Account Owner, may send to us (“Feedback”), including responses to questionnaires or through postings to the Pixel Parables service (if such features are made available to Account Owners), including the Pixel Parables website and user interfaces, without further compensation, acknowledgment or payment to you for any purpose whatsoever including, but not limited to, developing, manufacturing and marketing products and creating, modifying or improving the Pixel Parables service. Furthermore, by posting any Feedback on our site (if applicable), submitting Feedback to us, or responding to questionnaires, you grant us a perpetual, worldwide, non-exclusive, royalty-free irrevocable license, including the right to sublicense such right, and right to display, use, reproduce or modify the Feedback submitted in any media, software or technology of any kind now existing or developed in the future. This Feedback provision applies only to information submitted by you, the Account Owner, and does not contemplate the collection of personal information from children.

Please note Pixel Parables does not accept unsolicited materials or ideas for use or publication beyond the Feedback mechanisms described. Pixel Parables is not responsible for the similarity of any of its content or programming in any media to materials or ideas transmitted to Pixel Parables. Should you send any unsolicited materials or ideas, you do so with the understanding that no additional consideration of any sort will be provided to you, and you are waiving any claim against Pixel Parables and its affiliates regarding the use of such materials and ideas, even if the material or an idea is used that is substantially similar to the idea you sent.

Service Testing

From time to time, we test various aspects of our service, including our website, user interfaces, service levels, plans, promotions, features, availability of Content and interactive elements, delivery, and pricing, and we reserve the right to include you in or exclude you from these tests without notice. If you are selected to participate in a test or beta version of any of our products or service, you should not rely on nor expect the continued availability of these new products or services. Any information, data, content, or materials provided or displayed to you in or through any test or beta participation, or any knowledge you may have from or relating thereto, is the proprietary and confidential information of Company.

The Disclaimers of Warranties and Limitations of Liability set forth in these Terms of Use expressly apply to the use of Customer Service. We may utilize the services of third parties in providing you customer service support. You are expected to interact with our customer service agents in a respectful manner, and if we deem your interaction to be derogatory in nature, we reserve the right to terminate your subscription.

Your Conduct in Accessing the Pixel Parables Service

By accessing the Pixel Parables service, including the Pixel Parables website and user interfaces, you agree to use the Pixel Parables service, including all features and functionalities associated therewith, the website and user interfaces, and all Content and software associated therewith in accordance with all applicable laws, rules and regulations, including public performance limitations or other restrictions on the use of the service or Content therein.

In addition, you agree not to:

  • Upload, post, e-mail, or otherwise send or transmit any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment associated with the Pixel Parables service.
  • Impersonate any other person while using the Pixel Parables service.
  • Conduct yourself in a vulgar or offensive manner while using the Pixel Parables service.
  • Use the Pixel Parables service for any unlawful purpose.
  • Attempt to misuse, manipulate, or exploit the Custom Content generation tools to create outputs that are offensive, inappropriate, infringing, or otherwise outside the intended Christian and child-appropriate themes of the service; nor shall you attempt to probe for biases, vulnerabilities, or unintended behaviors in the underlying AI models.
  • Circumvent, remove, alter, deactivate, degrade, or thwart any of the content protections in the Pixel Parables service.
    Pixel Parables reserves the right, though not the obligation, to review Custom Content and to remove content or suspend/terminate accounts if such misuse is detected, in its sole discretion.

You agree that all of the foregoing restrictions apply not only to the Pixel Parables service, but also to the servers and networks connected to any portions of the Pixel Parables service whether operated by Pixel Parables or third parties (“Networks”). You agree not to interfere with Networks, violate any of the procedures, policies or regulations applicable to Networks, use Networks in a way that harms or impairs anyone else’s use of Networks, use Networks to gain unauthorized access to any service, data, account or other networks, use Networks to falsify any protocol or e-mail header information (e.g., “spoofing”), use Networks to send “spam” (i.e., unsolicited bulk e-mail or commercial messages) or items of a destructive or deceptive nature, or remove, modify, or tamper with any regulatory or legal notice or link that is incorporated into Networks. Pixel Parables may implement measures to restrict account access from multiple IP addresses simultaneously or in rapid succession if such activity is indicative of unauthorized account sharing or other misuse. If Pixel Parables determines, in its sole discretion, that an Account Owner has shared their account log-in information in a manner that violates these Terms or compromises account security or service integrity, Pixel Parables reserves the right to suspend or terminate the Account Owner’s account.

Limitations on Use

You must be 18 years of age or older to become a member of the Pixel Parables service and to be an Account Owner. In certain jurisdictions, the age of majority may be older than 18, in which case you must satisfy that age in order to become a member and Account Owner.

The Pixel Parables service is designed and intended for use by Account Owners (parents or legal guardians) to engage with their children, particularly those aged 1-4 years. While individuals under the age of 18, including children under 13, may utilize the service, they may do so only with the direct involvement, supervision, and approval of an Account Owner, under such Account Owner’s account, and otherwise subject to these Terms of Use. The Pixel Parables service is not intended to be used independently by children without the active participation and guidance of an Account Owner. As the Account Owner, you explicitly acknowledge this intended use model and agree that you will not permit independent or unsupervised access by children under your account.

Unless otherwise specified, the Pixel Parables service, and any Content viewed or generated through our service, are for your personal and non-commercial use only, as an Account Owner engaging with your child(ren). We grant you, the Account Owner, a limited, nonexclusive, nontransferable license to access the Pixel Parables service for that purpose. Except for the foregoing limited license, no right, title, or interest shall be transferred to you.

Except as expressly permitted by us (such as through the intended functionality of the Custom Content generation tools for personal use), you may not download (other than through page caching necessary for personal use, or as otherwise explicitly permitted by these Terms of Use for specific Content if offered), modify, copy, distribute, transmit, display, perform, reproduce, duplicate, publish, license, create derivative works from (beyond the scope of permitted Custom Content generation for personal use), or offer for sale any information or Content contained on, or obtained from or through, the Pixel Parables service, without our express written consent.

Pixel Parables does not promote, foster, or condone the copying of its Service Materials or any other infringing activity. You may not circumvent, remove, alter, deactivate, degrade, or thwart any of the Pixel Parables service’s content protections. You may not frame or utilize any framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Pixel Parables without our express written consent. You may not purchase search terms or use any meta tags or any other “hidden text” utilizing the Pixel Parables name or trademarks without our express written consent. Any unauthorized use of the Pixel Parables service or its contents will terminate the limited license granted by us and will result in the cancellation of your membership.

Some of the hyperlinks on the Pixel Parables website may lead to other websites or other content that are not controlled by or affiliated with Pixel Parables. In addition, other websites may link to the Pixel Parables website, or Pixel Parables may include links to the websites of businesses, including those that may have associations with us through certain programs. Pixel Parables has not reviewed all of these third-party websites and is not responsible for the offerings of any of these sites or the content, privacy policies, or terms of use of these websites or Applications. You acknowledge and agree that Pixel Parables is not responsible or liable for, and does not otherwise warrant, the actions of these third parties, the products or contents on their websites, or the performance of any Applications and devices. These linked websites have separate and independent privacy statements, notices, and terms of use, which we recommend you read carefully.

Promotions

Promotional codes may be redeemed on our website in accordance with the terms of the specific promotion. Promotional codes can typically only be used once per account, cannot be redeemed for cash, resold, or combined with any other offers unless specifically stated in the promotion'''s terms. If you received a promotion code through an offer by a third party, additional restrictions from that third party may apply. All promotions are subject to availability and may be withdrawn or modified by Pixel Parables at any time without prior notice (unless otherwise required by law).

Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Texas, U.S.A., without regard to its conflict of laws provisions. If any provision or provisions of these terms shall be held to be invalid, illegal, unenforceable, or in conflict with the law of any jurisdiction, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired thereby and shall remain in full force and effect.

Arbitration Agreement

You and Pixel Parables (RETVRN, LLC) agree that any dispute, claim, or controversy arising out of or relating in any way to the Pixel Parables service, including our website, user interfaces, these Terms of Use, and this Arbitration Agreement, shall be determined by binding arbitration instead of in courts of general jurisdiction. Arbitration is more informal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, allows for more limited discovery than in court, and is subject to minimal review by courts. Arbitrators can award the same damages and relief that a court can award. You agree that, by agreeing to these Terms of Use, the U.S. Federal Arbitration Act governs the interpretation and enforcement of this provision, and that you and Pixel Parables are each waiving the right to a trial by jury or to participate in a class action. This arbitration provision shall survive termination of this Agreement and the termination of your Pixel Parables membership.

If you elect to seek arbitration, you must first send to Pixel Parables, by certified mail, a written Notice of your claim (“Notice”). The Notice to Pixel Parables should be addressed to: RETVRN, LLC, Attn: Legal Department, 603 Main St., Ste 201, Garland, TX 75040 (“Notice Address”). If Pixel Parables elects to seek arbitration, it will send a written Notice to the e-mail address used for your membership account. A Notice, whether sent by you or by Pixel Parables, must (a) describe the nature and basis of the claim or dispute; and (b) set forth the specific relief sought (“Demand”).

If you and Pixel Parables do not reach an agreement to resolve the claim within 30 days after the Notice is received, you or Pixel Parables may commence an arbitration proceeding or file a claim in small claims court. During the arbitration, the amount of any settlement offer made by Pixel Parables or you shall not be disclosed to the arbitrator until after the arbitrator determines the amount, if any, to which you or Pixel Parables is entitled. You may download or copy a form Notice and a form to initiate arbitration at www.adr.org.

If you are required to pay a filing fee, after Pixel Parables receives notice at the Notice Address that you have commenced arbitration, Pixel Parables will promptly reimburse you for your payment of the filing fee, unless your claim is for greater than US$10,000. The arbitration will be governed by the Commercial Arbitration Rules and the Supplementary Procedures for Consumer-Related Disputes (collectively, “AAA Rules”) of the American Arbitration Association (“AAA”), as modified by this Agreement, and will be administered by the AAA. The AAA Rules and Forms are available online at www.adr.org, by calling the AAA at 1-800-778-7879, or by writing to the Notice Address. The arbitrator is bound by the terms of this Agreement. All issues are for the arbitrator to decide, including issues relating to the scope and enforceability of this arbitration agreement.

Unless you and Pixel Parables agree otherwise, any arbitration hearings will take place in Dallas County, Texas. If your claim is for US$10,000 or less, we agree that you may choose whether the arbitration will be conducted solely on the basis of documents submitted to the arbitrator, through a telephonic hearing, or by an in-person hearing as established by the AAA Rules. If your claim exceeds US$10,000, the right to a hearing will be determined by the AAA Rules. Regardless of the manner in which the arbitration is conducted, the arbitrator shall issue a reasoned written decision sufficient to explain the essential findings and conclusions on which the award is based.

If the arbitrator issues you an award that is greater than the value of Pixel Parables’ last written settlement offer made before an arbitrator was selected (or if Pixel Parables did not make a settlement offer before an arbitrator was selected), then Pixel Parables will pay you the amount of the award or US$1,000, whichever is greater. Except as expressly set forth herein, the payment of all filing, administration, and arbitrator fees will be governed by the AAA Rules.

YOU AND PIXEL PARABLES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and Pixel Parables agree otherwise, the arbitrator may not consolidate more than one person’s claims with your claims and may not otherwise preside over any form of a representative or class proceeding. If this specific provision is found to be unenforceable, then the entirety of this arbitration provision shall be null and void. The arbitrator may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim.

Indemnification

You agree to indemnify, defend, and hold harmless RETVRN, LLC, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys''' fees) that such parties may incur as a result of or arising from your (or anyone using your account'''s) violation of these Terms of Use or your use of the Pixel Parables service, including but not limited to your generation or use of Custom Content.

Assignment

You may not assign or transfer these Terms of Use, by operation of law or otherwise, without Pixel Parables’ prior written consent. Any attempt by you to assign or transfer these Terms of Use, without such consent, will be null. Pixel Parables may freely assign or transfer these Terms of Use without restriction. Subject to the foregoing, these Terms of Use will bind and inure to the benefit of the parties, their successors and permitted assigns.

Severability

If any provision of these Terms of Use shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions.

Survival

The provisions of these Terms of Use which by their nature should survive the termination of these Terms of Use or your membership (including, but not limited to, provisions governing arbitration, intellectual property, disclaimers of warranties, limitations of liability, indemnification, and governing law) shall survive such termination.

Waiver

No waiver of any provision of these Terms of Use by us shall be deemed a further or continuing waiver of such provision or any other provision, and our failure to assert any right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

Entire Agreement

These Terms of Use, together with the Privacy Policy and any other legal notices or specific terms for certain features published by Pixel Parables on the service (which you agree to when using such features), constitute the entire agreement between you and Pixel Parables concerning your use of the service and supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and Pixel Parables with respect to the service.
